Appeals exists to facilitate negotiation and possible settlement of tax liabilities without having to go through an expensive trial. The stated mission of Appeals is to resolve tax controversies in a fair and impartial basis to both the IRS and the taxpayer, without litigation. IRM 8.1.1.1.  Appeals handles proper and timely filings after the IRS agent examination is completed. It also handles timely appeals of collection actions such as liens, levies, seizures, or denial of installment agreements. The Office of Appeals can also handle appeals of collection due process hearings, offers in compromise, and some abatement claims. IRM 8.1.3.1

Tax Litigation before the US Tax Court
A tax professional’s goal in every tax controversy matter should be to resolve the tax dispute quickly and efficiently, at the earliest stage possible, and preferably, without litigation. A non-lawyer can only represent taxpayers through the agent examination level, but not beyond. Unfortunately, at the agent level, the IRS generally gets everything it claims. That means taxpayers sometimes lose when they resolve matters at the agent level because they have the right to dispute IRS positions. Taxpayers do not have to sign and agree with the IRS agent since they still have rights beyond the agent examination level.
